Yes, If the accident was not your fault and you can prove a need for a replacement vehicle similar to your own. The cost of which is recoverable from the 'at fault' party or his/her insurance company on a credit hire basis.
Your vehicle may be deemed un-economical to repair, usually if the costs of repairs are more than a certain percentage of the current value of your vehicle. You may be seriously disadvantaged if your vehicle is not repaired as you may be liable for the outstanding hire purchase or leasing commitments. Very often a borderline case may be a repairable proposition if second hand parts are acceptable in the repair. The Engineer / Assessor will advise you if this applies. You are entitled to stay in the replacement vehicle for a period of up the seven days until the write off cheque is received.
Usually, no. By claiming from the 'at fault' party's insurer, you will not be making a claim under your own insurance policy and therefore would not have to pay a policy excess. In some cases, to speed up the repair to your vehicle, you may be better claiming under your own policy and then claiming the excess from the fault party's insurer.
You will be offered an insurance which covers you for the hire charges, repair costs and legal expenses incurred in pursuing your claim should these not be recovered from the 'at fault' party or his/her insurers provided that you have represented the circumstances of the accident accurately and have co-operated in your claim.
Yes, provided that it be shown that the expenses were incurred as a direct result of the accident and there is proof of expenditure, any expenses arising as a result of the accident should be recoverable. This might include loss of earnings or medical expenses incurred due to an injury suffered in the accident.
Yes, this should be possible although the amount may vary depending on the vehicle. When your car has been involved in an accident, it may not be worth what it was before it was damaged no matter how well it is repaired. You may be entitled to compensation for this loss in value, which will be determined by using independent evidence.
